Welcome to ALA Underscrubs. These Terms of Service ("Terms") are an agreement between you and ALA UNDERSCRUBS LLC, a Utah limited liability company ("ALA Underscrubs", "we", "us" or "our"), and govern your use of our website located at alaunderscrubs.com (the "Site") and your purchase of products from us. By accessing or using our Site, you agree to be bound by these Terms.

Please read these Terms carefully before using our Site or making a purchase. If you do not agree to these Terms, you must not use our Site.

Pricing

All prices are listed in US dollars and are subject to change without notice. We reserve the right to correct any pricing errors. If a product is listed at an incorrect price, we will notify you and give you the option to proceed at the correct price or cancel your order.

Availability

Product availability is subject to change. We reserve the right to limit quantities or discontinue products at any time without notice.

4. Orders and Payment

By placing an order, you are making an offer to purchase products. We reserve the right to accept or decline your order for any reason, including but not limited to:

• Suspected fraud or unauthorized transactions

Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout. You represent that you are authorized to use the payment method provided.

5. Shipping and Delivery

Shipping times and costs are estimates and are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control.

7. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of ALA Underscrubs or our content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

8. User Content

If you submit reviews, comments, or other content to our Site, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content in connection with our business.

You represent that you own or have the rights to the content you submit and that it does not violate any third-party rights or applicable laws.

9. Warranties

(a) Products. Our products are covered by our Limited Warranty at alaunderscrubs.com/pages/limited-warranty. Nothing in these Terms disclaims, excludes or limits any implied warranty on our products (including the implied warranties of merchantability and fitness for a particular purpose), or any right you have under a law that cannot be varied by agreement.

(b) The Site. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES ABOUT THE SITE ITSELF, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALA UNDERSCRUBS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in this Section limits our obligations under our Limited Warranty, or any implied warranty on our products, beyond the exclusion of incidental and consequential damages stated in our Limited Warranty.

Our total liability for any claims arising from these Terms or your use of the Site shall not exceed the amount you paid for the products giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless ALA Underscrubs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Site.

12. Governing Law; Venue; Contracting Party

(a) These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any order placed through the Site — whether based in contract, tort, statute, or any other theory — are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.

(b) Nothing in these Terms deprives you of the protection of any consumer-protection law of the state in which you reside that cannot be varied by agreement. Where such a law applies to your purchase, it applies.

(c) Except as provided in Section 12(d), any action arising out of or relating to these Terms or any order shall be brought exclusively in the state or federal courts located in the State of Utah, and you and we each consent to personal jurisdiction and venue in those courts.

(d) You may instead bring an individual claim in the small claims court of the county or district where you reside, if your claim qualifies for that court.

(e) Except as set out below, the party contracting with you is ALA UNDERSCRUBS LLC, a Utah limited liability company. For orders delivered outside the United States, the seller is Global-e US Inc., as described in its Terms of Sale shown at checkout; ALA UNDERSCRUBS LLC remains the warrantor under our Limited Warranty for those orders.

13. Changes to Terms

We may modify these Terms from time to time. Any change applies only going forward and never to an order you have already placed: each order is governed by the version of these Terms in effect at the time that order was placed. We will post the date of the most recent revision at the top of this page. If you do not agree to a revised version, you may stop using the Site.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
